Terms and Conditions

Article 1 - Definitions

 Platform: The website nooitteduur.nl and all associated subdomains and services.

 User: Any visitor to the Platform, divided into “Advertiser” (the party placing an advertisement) and “Buyer/Visitor” (the party viewing advertisements).

 Agreement: The agreement between nooitteduur.nl and the Advertiser for the provision of advertising space (whether or not for a fee).

Article 2 - Applicability and Role of the Platform

1. These terms and conditions apply to any use of the Platform and to all services offered by nooitteduur.nl.

2. nooitteduur.nl is expressly not a party to the transactions between Buyers and Advertisers. The Platform functions exclusively as an online marketplace where advertisers and potential buyers can connect with one another. nooitteduur.nl bears no responsibility for the quality, safety, or legality of the advertised vehicles, boats, or RVs.

Article 3 - Rules for Advertising

1. The Advertiser is fully responsible for the content of the posted advertisement (including text, prices, and photos).

2. The Advertiser guarantees that the vehicle, boat, or RV being offered is their property, or that they are authorized to sell it on behalf of the owner.

3. It is not permitted to:

 Post inaccurate, misleading, or offensive information.

 Infringe on the intellectual property rights of third parties (for example, by using photos that do not belong to you).

 Post the same ad multiple times.

4. nooitteduur.nl reserves the right at all times to modify, refuse, or remove advertisements without providing a reason, particularly if they violate these terms and conditions.

Article 4 - Prices, Offers, and Payment

1. In the case of paid ad packages or (launch) promotions, the current prices are clearly stated on the Platform. All prices listed are ⁠[inclusive of / exclusive of]⁠ VAT.

2. Payment for paid services must be made in advance using the digital payment methods offered on the Platform.

3. Once the advertising service has been provided (the ad is online), a refund of the amount paid is no longer possible, unless otherwise required by law.

Article 5 - Exclusion of the Right of Withdrawal (for consumer advertisers)

1. By placing an advertisement digitally, the Advertiser agrees that the provision of the service begins immediately. By doing so, the Advertiser waives the statutory right of withdrawal (cooling-off period), as the service is performed in full immediately.

Article 6 - Intellectual Property and License

1. The intellectual property rights to the Platform (including the NTD logo, corporate identity, and software) are owned by nooitteduur.nl.

2. By placing text and images in an advertisement, the Advertiser grants nooitteduur.nl a royalty-free, worldwide license to display, reproduce, and use this content for the promotion of the Platform.

Article 7 - Liability and Indemnification

1. nooitteduur.nl is not liable for any damages arising from the use of the Platform, including (but not limited to) failed transactions between Buyers and Advertisers, or damage to vehicles.

2. nooitteduur.nl does not guarantee that the Platform will be accessible at all times without interruptions or errors.

3. The Advertiser indemnifies nooitteduur.nl against all third-party claims related to the advertisement or content posted by the Advertiser.

Article 8 - Governing Law and Disputes

1. These general terms and conditions and all agreements are governed exclusively by Dutch law.

2. Disputes shall in the first instance be submitted to the competent court in the judicial district where nooitteduur.nl is located.
